These Terms of Service cover smostly.com and the PINGOT mobile application (collectively, the "Services"), both operated by Smostly LLC.

Acceptance of Terms

By downloading, installing, or using PINGOT ("the App"), developed and operated by Smostly LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

Description of Service

PINGOT is a personal precious metals portfolio tracker. The App allows you to log holdings, view estimated portfolio values based on third-party spot price data, search coin catalogs, and identify coins using AI-assisted image recognition. The App is an informational and record-keeping tool only.

Not Financial Advice

Nothing in the App constitutes investment, financial, tax, or legal advice. All asset values displayed are indicative estimates based on delayed third-party spot price data. Prices shown are not executable trade prices. PINGOT, its creators, and affiliates are not registered financial advisors. Always consult a qualified professional before making financial decisions.

Account Registration

To use certain features, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

Premium Subscription

PINGOT offers a Premium subscription plan with additional features. Subscriptions are billed annually through the Apple App Store or Google Play Store. Payment is charged to your store account at confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your device's store settings. Refunds are handled according to Apple or Google's refund policies.

User Data and Content

You retain ownership of all data you enter into the App (holdings, notes, etc.). By using the App, you grant us a limited license to store, process, and display your data solely for the purpose of providing the App's functionality. You are solely responsible for the accuracy of the information you enter.

Vault Removal Feature

The Vault Removal feature is purely administrative. It allows you to log the removal of an asset from your digital tracker. PINGOT does not facilitate, broker, or process any physical asset transactions or external sales. All transactions are assumed to have occurred externally and are recorded solely for your personal record-keeping.

Data Accuracy Disclaimer

PINGOT does not guarantee the accuracy, timeliness, or completeness of any market data, spot prices, coin identification results, or catalog information. Data is sourced from third parties (Metals.dev, Numista, Google Gemini AI) and may be delayed, incomplete, or incorrect. You should independently verify any information before relying on it.

Prohibited Uses

You agree not to: use the App for any unlawful purpose, attempt to gain unauthorized access to our systems or other users' data, interfere with or disrupt the App or its servers, reverse-engineer or decompile the App, or use the App to facilitate money laundering or the sale of stolen property.

Limitation of Liability

To the maximum extent permitted by law, PINGOT and its creators will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including but not limited to financial loss, data loss, or data inaccuracies. The App is provided "as is" without warranties of any kind.

Data Management

You are solely responsible for exporting, backing up, or securing your own data. PINGOT is not liable for data loss due to device failure, app deletion, forgotten passwords, or operating system updates.

Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination will remain in effect.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable rules.
